1. How to enter: There are two (2) ways to enter the sweepstakes:

A) Enter online: Click here and follow links and instructions for entry.

B) Enter by Mail: Hand print (or type) your name, address, day and evening phone numbers, email address (if any), age, and company name (if applicable) on a 3”x5” piece of paper. Mail it in a hand-addressed envelope to WARM2Kids, 61 North Beacon St, Boston, MA 02134 LIMIT: one (1) card per separately mailed envelope. All mail entries must be postmarked by February 1, 2007 and received by the close of business on December 31st, 2007.
Entries by facsimile will not be accepted. LIMIT: Ten (10) entries per person by any method or combination of methods of entry during the Promotion Period.

2. Prizes and Odds of winning: $100 Worth of Prepaid iTunes Music. Odds of winning in this particular drawing depends on the number of eligible entries received for the drawing.

3. Eligibility: This sweepstakes is open only to legal residents of the 50 United States (and the District of Columbia) who are at least 13 years old at the time of the entry. Minors under the age of 21 must obtain the consent of their parent or legal guardian in order to enter the contest. Employees of WARM2kids, and their respective related companies, agents, suppliers, as well as immediate family (spouses, parents, siblings and children) and household members of each such employee are not eligible. Subject to all Federal, state and local laws and regulations. Void were prohibited.

4. Duration: The Sweepstakes begins at 12:00:00 a.m. Eastern Time (“ET”), December 1, 2006 and ends at 11:59:59 p.m., ET Decemeber 31st, 2007 (the “Promotion Period”).

5. Drawing: The drawing will be a random drawing.  The drawing will be done by WARM2Kids. The Entrant that is selected must comply with all of the terms and conditions of these official rules and winning is contingent upon fulfilling all requirements. Except where prohibited, the potential winner must sign and return to WARM2Kids, within ten (10) days of being notified, an affidavit of eligibility and liability/publicity release in order to claim his/her prize. If a potential winner cannot be contacted within ten (10) days after the first attempt to contact him/her or if he/she fails to sign and return the Affidavit of Eligibility and the liability/publicity release with in the required time period, an alternate entrant will be selected in his/her place at random among all eligible entries received.

6.General Rules: All entries become the exclusive property of WARM2Kids and none will be acknowledged or returned. Proof of sending or submission will not be deemed to be proof of receipt by WARM2Kids. WARM2Kids is not responsible for lost, late, incomplete, invalid, unintelligible, misdirected or postage due entries, which will be disqualified.

By entering this Sweepstakes, entrant agrees to release and hold harmless, WARM2kids, each of their related companies, and each of their respective officers, directors, employees, and agents from and against any claim or cause of action arising directly or indirectly, in whole or in part, out of participation in the Sweepstakes or receipt or use of any prize.

By participating in the Sweepstakes, each entrant fully and unconditionally agrees to and accepts these official rules and the decisions of the WARM2Kids, which are final and binding.

If by reason of a printing or other error, more prizes are claimed than the number set forth in these official rules, all persons making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded.

7. Publicity Release: Except where prohibited, participation in the Sweepstakes constitutes winner’s consent to WARM2Kids’ use of winners name, likeness, voice, opinions, biographical information, hometown and State for promotional purposes in any media without further payment or consideration.

8. Taxes: Each winner is solely responsible for all Federal, State and local taxes and other fees associated with prize receipt and use. WARM2Kids will not replace lost or stolen prizes. No substitution, assignment or transfer of prizes permitted, except by WARM2Kids, who reserves the right to substitute any prize or combination of prizes with another prize of greater or equal value.

9. Internet Liability: WARM2Kids is not responsible for lost, late, mutilated or illegible entries not for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by WARM2Kids or presenter on account of technical problems or traffic congestion on the internet or at any website or any combination thereof. If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of WARM2Kids which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this sweepstakes, WARM2Kids reserves the right as its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the sweepstakes. Caution: Any attempt by a contestant to deliberately damage any website or undermine the legitimate operation of the game is a violation of criminal and civil laws and should such an attempt be made, WARM2Kids reserves the right to seek damages from any such contestant to the fullest extent of the law.

In the event of a dispute as to online entry, the WARM2kids membership holder will be deemed to be an entrant.

10. Winner’s List: Sweepstakes results and a copy of these official rules may be obtained by sending a self-addresses, stamped envelope to WARM2Kids, 61 North Beacon St, Boston, MA 02134. Request must be received within 30 days after applicable drawing date.

11. Choice of Law: All issues and questions concerning the validity, interpretation, enforceability of all these Official Rules, or the rights and obligations of entrants (and any parent/legal guardian if such entrant is an eligible minor) and/or companies in connection with this sweepstakes, shall be governed, without regard for conflicts of law doctrine, and all related proceedings shall take place in the Commonwealth of Massachusetts.
